NO OBLIGATION IS NECESSARY. CONTEST VOID WHERE PROHIBITED. By participating in the Contest, you agree to be abide by all rules and decisions of Streamlicious, and you are deemed to accept these General Contest Rules.
Streamlicious team are ineligible to participate in the Contest.
Contestant must be a natural person of legal capacity and fulfill any applicable legal residency requirements.
The Contest will end on 26 November 2012. The representatives of Streamlicious are the only official timekeeper for the Contest.
Streamlicious reserves the right to disqualify late, lost, illegible, misdirected, damaged, incomplete, improperly submitted or otherwise irregular Contest entries.
To the extent permitted by local laws, submission of a Contest entry shall be deemed consent to Streamlicious recording or using the Contestant’s name, photograph, likeness, voice, statements, biographical information and contact details worldwide in all forms of media, in perpetuity, without further compensation.
Streamlicious assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of entries, or any problem or technical malfunctions of any telephone network or line, computer online systems, servers, or providers, computer equipment, software, failure of any online Contest entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, which may limit a Contestant’s ability to participate in the Contest.
In the event of any dispute, an online Contest entry is deemed submitted by the registered internet or e-mail account holder associated with such entry.
Prizes are offered “as is” with no written, express, or implied warranty. No transfer, substitution, exchange or cash equivalent is allowed.
Streamlicious will notify the Winner of their Prize by email. Any failure by Winner to respond within a period of fourteen (14) calendar days shall result in Prize forfeiture and selection of an alternate Winner. The same outcome shall apply to any undeliverable Prize.
If a Prize cannot be awarded for any reason, Streamlicious may substitute with another item of equivalent kind or comparable value.
Except for costs specifically expressed to be borne by Streamlicious , all taxes, insurance, installation, fees and other charges and expenses associated with a Prize remain the sole responsibility of the Winner. If a Prize is mailed, the Winner assumes the risk of the Prize’s safe arrival.
Streamlicious retains full discretion to disqualify a Contestant at any time if, in the opinion of Streamlicious, any Contest rule has been infringed. In the event of disqualification, any Prize won shall be forfeited.
Contestant agrees that any dispute arising out of or in connection with the Contest shall be resolved individually, without resort to any form of class action. Any claim, judgment and award shall be limited to actual out-of-pocket costs incurred. In no event will attorneys\’ fees be awarded or recoverable. Contestant knowingly and expressly waives all rights to punitive, incidental or consequential damages and any other damages apart from actual out-of-pocket expenses.
Contestant agrees to release, discharge, indemnify and hold harmless Streamlicious, its affiliates, its business partners or prize providers, and directors, officers, employees and agents of any and all of the aforesaid, from and against any claim, damages or liability due to any injuries, losses or damages to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, enjoyment, ownership, possession, use, misuse or inability to use any Prize, or participation in the Contest or a related activity, whether under contract, tort (including negligence), warranty or any other applicable sources of law.
Streamlicious assumes no responsibility for any administrative errors in the course of operating the Contest.
Streamlicious is entitled to cancel, terminate, modify, suspend the Contest at any time without notice. Any Contest rule may be revised, updated or supplemented at any time without notice.
Contestant agrees to waive any right to claim ambiguity in the Contest rules. Interpretation by Streamlicious of a Contest rule shall be final, conclusive and binding. No correspondence or claims will be entertained.
The Contest and any dispute or issue arising under it shall be governed by the laws of the state of California, without regard to principles of conflict of laws. If the whole or any part of a Contest rule may prove to be illegal or unenforceable, the other Contest rules and the remainder of the Contest rule in question shall remain in full force and effect.
